TASIKMALAYA, Thecuy.com – A labor termination dispute between sales representative Diky Septiana Sulistianto and his former employer located in Tasikmalaya City has yet to find a resolution.
The mediation facilitated by the Tasikmalaya City Manpower Service (Disnaker) recently concluded without reaching an agreement.
Diky contested the termination, which he claims was carried out unilaterally by the company.
He believes the process was not preceded by a warning letter (SP) or a sufficient opportunity for clarification.

Diky suspects there was unequal treatment compared to other employees alleged of similar violations, who were still given a chance for clarification or only received a warning letter (SP).
The head of the Tasikmalaya City Disnaker, Deni Diyana, clarified that Diky’s main demand pertained to compensation because the employment contract was terminated before its term concluded.
“Kalau salah satu pihak memutus kontrak sebelum masa kontraknya habis, pihak yang memutus itu harus membayar ganti rugi,” kata Deni saat ditemui, Senin (10/8).
Nevertheless, Deni said the company had its own reasons for terminating the contract. The company alleged that Diky committed a serious violation based on the results of an internal audit.
“Perusahaan menyampaikan hasil audit, Diky melakukan fraud atau pelanggaran yang sifatnya berat,” ujarnya.
Deni stated that the accusation was related to an alleged data falsification or other offenses. However, if it involved data falsification, he considered it a criminal matter, beyond Disnaker’s authority to examine the criminal aspect.

Deni said Disnaker would subsequently issue a recommendation based on the facts that emerged during the mediation process.
The recommendation would not be based solely on one party’s desire, but would be considered by the mediator after reviewing the issue as a whole.
