PANGANDARAN, Thecuy.com —A call to cancel the certificate of ownership for the sea harim of Pantai Madasari could create additional problems if carried out. Nevertheless, the regency government could use its licensing authority to protect the area.
Former Pangandaran Regent H Jeje Wiradinata commented on the certificate of ownership for coastal buffer land (harim land) in the Pantai Madasari area, Masawah Village, Cimerak District. According to him, this issue is not new, being the result of past policies, including the issuance of the Land Redistribution Decree (SK Redis) during the New Order era up to the previous governor’s term.
There are many land cases that violate regulations, not just in Pantai Madasari; both river and sea harim; those are usually products of the New Order era or previous policies. The SK Redis might have been issued by the Governor, he said on Monday (31/8/2026).

Regarding the mechanism for resolving certificates on coastal buffer land, Jeje says the procedure is not simple. Legally, cancellation of a certificate has only two main pathways: direct cancellation by the National Land Agency (BPN) or through a civil lawsuit in court, which takes a long time up to the Review level.
However, Jeje doubts BPN’s willingness to cancel a product they themselves issued because of the risk of facing counter-suits from certificate holders.
The question is, does BPN want to cancel its own product? Not necessarily, because it is vulnerable to being sued by the certificate owner. The land buyers are actually victims too. They bought because there was an SK Redis and legality was issued; perhaps they didn’t know it was coastal harim land,” he revealed.
In this case, the regency government does not have major authority regarding SHM (certificate of ownership), but licensing services can be a weapon. That means the area cannot be built on provided that the regency government is consistent in not issuing Building Permit (PBG) on coastal buffer land and the Madasari ancestral burial area.
The Regent’s authority is limited; he cannot cancel a certificate. But there is a last resort: do not issue the construction permit; the PBG must not be issued! Even if he has a certificate, if the regional government does not give a building permit, it’s over. The land cannot be touched,” he said.
