In his reasoning, the judge cited Article 175 paragraph (5) of Law Number 20 of 2025 concerning the Criminal Procedure Code, which requires a government regulation on compensation payments. However, such a regulation has not yet been enacted.
Consequently, the judge turned to Article 365 of the Criminal Procedure Code and Article 11 of Government Regulation Number 27 of 1983, as amended by Government Regulation Number 92 of 2015. These provisions stipulate that compensation must be disbursed by the finance minister pursuant to a court order within a maximum of 14 working days from receipt of the request.
Kendala dalam Permohonan Praperadilan
The judge stressed that Roy Suryo’s side failed to include the Minister of Finance as a respondent in this pre-trial motion, rendering the petition procedurally defective and inadmissible. The judge also ruled that the petitioner would not be charged any court fees.
