MA Koreksi Kerugian Negara Kasus Korupsi Timah, Sebut Nilainya Bukan Rp 300 Triliun

Thecuy.com – The Supreme Court (MA) revised the amount of state financial loss in the tin ore management corruption case at PT Timah Tbk, Bangka Belitung. The cassation ruling by the MA says the state loss is not Rp 300 trillion as the initial audit by the Financial and Development Supervisory Agency (BPKP), but approximately Rp 28 trillion.

This decision came after the MA rejected the loss calculation that included environmental loss worth around Rp 271 trillion in the state financial loss calculation. The MA affirmed that environmental loss must be separated from state financial loss because both have different legal regimes.

The Corruption Court (Tipikor) only has authority to adjudicate certain state financial losses, namely those resulting from the improper disbursement of state funds. Meanwhile, district courts address environmental losses through specific environmental criminal or civil mechanisms.

Furthermore, the MA also rejected a reconsideration (PK) filed by Tamron alias Aon, a smelter executive convicted of tin commodity trade management corruption. As a result of this rejection, Tamron’s 18-year prison sentence, which was increased by the DKI Jakarta High Court, remains in effect and is final.

On the other hand, the Constitutional Court (MK) together with the MA, the Attorney General’s Office, and the BPKP affirmed that determining state losses in corruption cases is the judge’s authority based on all evidence revealed during the trial. Audit results from institutions such as the BPK, BPKP, or inspectors’ offices only serve as one piece of evidence that must be evaluated together with other evidence.

The material review hearing concerning the calculation of state losses is crucial as it underscores the judge’s role in ascertaining the extent of state financial loss that serves as the basis for proving criminal corruption.
